The most common type of bodily injury is that resulting from car accidents. The UAE legislator has protected the rights of the injured party by requiring drivers, before licensing their vehicles, to ensure they are insured for the benefit of at least third parties.
This condition protects the rights of the injured party from third parties who are injured, whether they are pedestrians or passengers in public or private transportation. The injured party can directly seek compensation from the insurance company that insured the vehicle that caused the accident, or from the person responsible.
Even if the driver of the vehicle is not the owner, the owner can sometimes be held liable. Ultimately, the legislator has protected the rights of those injured in a traffic accident by allowing them to seek compensation from the insurance company for bodily injuries and any resulting disability, as well as blood money (diya) and compensation for loss of limbs or their functions.
This article, written by lawyers specializing in car accident injuries and insurance claims in Dubai, Abu Dhabi, and the UAE, particularly The Black Rope team, aims to clarify the rights of those injured in car accidents and who bears responsibility in such accidents.
In the event of an accident, the company is obligated to compensate the injured person, within the limits of its liability as stipulated in the unified policy, for all amounts that the insured or the vehicle driver is legally obligated to pay as compensation for the following:
A. First: Death or any bodily injury sustained by any person, including vehicle passengers, with the exception of the insured, the driver of the vehicle causing the accident, and passengers employed by the insured if injured during and as a result of their work.
A person is considered a vehicle passenger whether inside the vehicle, boarding it, or alighting from it. The maximum liability of the company for any claim or series of claims arising from a single accident is the value of the court-ordered compensation, regardless of its amount.
Second: In the event of the death of a spouse, parent, or child, the maximum compensation is AED 200,000 (two hundred thousand dirhams) for each deceased person. In the case of injury resulting in disability, compensation is calculated based on the percentage of disability, multiplied by AED 200,000 (two hundred thousand dirhams), in addition to the medical expenses incurred by the injured party.
Third: In all cases of injury, the insurance company is obligated to cover all treatment expenses incurred by any medical service provider, including all government and private hospitals, pharmacies, and any treatments required by the case. If treatment is not completed, the insurance company will issue a letter of commitment addressed to the treating facility.
The insurance company's liability is limited to the amount of the court-ordered compensation, regardless of its value, including any court fees and expenses claimed by the plaintiff, excluding fines. The company must pay the compensation to the rightful claimant immediately upon the court judgment becoming enforceable.
